A BILL to amend and reenact section nineteen, article four-c,
chapter sixteen of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, relating to emergency
medical services; and making it a felony to attack,
obstruct, hinder or interfere with emergency medical
services or rescue personnel responding to an emergency or
returning to their station following an emergency response.
Be it enacted by the Legislature of West Virginia:
That section nineteen, article four-c, chapter sixteen of
the code of West Virginia, one thousand nine hundred thirty-one,
as amended, be amended and reenacted to read as follows:
ARTICLE 4C. EMERGENCY MEDICAL SERVICES ACT.
§16-4C-19. Attacking or obstructing emergency medical services
or rescue personnel.
Any person who knowingly or intentionally attacks, hinders,
obstructs or interferes with emergency medical services or rescue
personnel performing or attempting to perform functions or dutiesas emergency medical services or rescue personnel, or returning
to their station after performing those functions or duties,
shall be guilty of a misdemeanor, and, upon conviction thereof,
shall be fined not more than one thousand dollars or confined in
the county jail for a period not exceeding one year, or both
fined and confined is guilty of a felony, and, upon conviction
thereof, shall be imprisoned in the penitentiary not less than
one nor more than ten years.
NOTE: The purpose of this bill is to make it a felony to
attack, obstruct, hinder or interfere with emergency medical
services or rescue personnel responding to an emergency or
returning to their station following an emergency response.
